Back on February 3rd I wrote an article about Trump’s tariff policy questioning his use of the International Emergency Economic Powers Act (IEEPA) to declare a national emergency. Yesterday, the New York-based Court of International Trade’s struck down the tariffs Trump imposed on all U.S. trade partners with his April 2 executive order.
The basis for the ruling was the court’s decision that Trump had overstepped his executive authority to establish his sweeping tariffs against all nations based upon this law.
I am not surprised by this decision, and frankly, I welcome it. As you all know, I have been railing against the expansion of executive power by both democrat and republican presidents, and Trump’s orders have simply gone too far against my understanding of our constitutional system of government.
I realize that there are many who will criticize this decision as judicial overreach, but honestly, if there is one branch that I can tolerate overreaching, it’s the judiciary. Not that I believe this decision is overreach. On the contrary, it is correct.
Article 1, Section 8 of the Constitution states that Congress shall have the power, “To regulate Commerce with foreign Nations…”. That’s pretty clear language.
By invoking the International Emergency Economic Powers Act (IEEPA), Trump has attempted to circumvent this constitutional mandate, and his hand has been caught in the cookie jar. I have been hoping that someone would challenge him on legal grounds, and am happy to see that it has happened.
Nevertheless, I suspect he will try another approach as there are other ways to limit foreign trade besides tariffs. Unfortunately, his attempts will create more economic chaos.
Trump may have been knocked to the canvas, but he’s nowhere near being knocked out.
The appeals court has only stayed the order of the International Trade Court. The merits of the decision are still to be decided. Question: Would you support a president imposing tariffs to fight climate change?
